This Privacy Policy explains how SafeHer collects, uses, and shares information when you use our iOS app ("SafeHer" or the "App"). SafeHer is a personal-safety recorder, and because of what it does, it handles sensitive information including video, audio, and your precise location. Please read this policy carefully.

We do not sell your personal information. We share information only with the service providers ("processors") that help us operate the App, and only as needed to provide the service. These processors are:

Your recordings are private to you. They are not publicly accessible. They become viewable by another person only when you choose to share a Live Witness link, in which case anyone who has that link can open the associated session.

We may also disclose information if required to do so by law, subpoena, or other legal process, or where we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or respond to a government request. We may also share or transfer information in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

Data Retention

We retain your account information for as long as your account is active. We retain your recordings, their associated location data, and shareable links until you delete them or close your account, so that your evidence remains available to you when you need it. Copies of recordings stored on your device remain there until you remove them. AI assistant messages, analytics events, and crash diagnostics are retained for the period needed to operate and improve the App and to meet our legal obligations, after which they are deleted or de-identified. When you ask us to delete your data or close your account, we will delete or de-identify your information within a reasonable period, except where we are required to retain it by law.

Depending on where you live, you may have the right to access, correct, or delete the personal information we hold about you, to receive a copy of it, and to opt out of certain processing. You can:

Security

We use technical and organizational measures designed to protect your information, including encryption in transit, access controls, and storing your recordings in private cloud storage that is not publicly listable. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for deciding with whom you share Live Witness links, since anyone who has a link can open the associated session.

Children's Privacy

SafeHer is not directed to children under 13, and we do not knowingly collect personal information from children under 13. The App is intended only for users who are 17 years of age or older. If you believe a child under 13 has provided us with personal information, please contact us at ceo@railsplitgames.com and we will take steps to delete it.

International Users

We are based in the United States, and our service providers, including Supabase, process and store information in the United States. If you access the App from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States and other countries where our processors operate. These countries may have data-protection laws that differ from those in your country. By using the App, you consent to this transfer and processing.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice within the App. Your continued use of the App after an update takes effect means you accept the revised policy.

These Terms of Service ("Terms") govern your use of the SafeHer iOS app (the "App" or the "Service"), published by RailSplit Games LLC ("we", "us", or "our"). Please read them carefully, including the important safety disclaimer below.

Acceptance of Terms

By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.

Eligibility

You must be at least 17 years old to use the App. By using the App, you represent and warrant that you are 17 or older and that you have the legal capacity to enter into these Terms.

Description of the Service

SafeHer is a personal-safety recorder. When you activate a panic trigger, the App records video and audio, captures your precise location, stores a copy of the recording on your device, and uploads a copy to the cloud. It can also generate a shareable "Live Witness" web link that a trusted contact you choose can open, so that evidence may survive even if your phone is lost or destroyed. The App also includes an optional AI-assistant chat and a "Decoy Mode" disguise feature.

Subscriptions, Billing, and Free Trials

Certain features of the App require a paid subscription. Subscriptions are sold and billed through the Apple App Store, and our subscription entitlements are managed through RevenueCat. Payments are handled by Apple - we never receive your payment card numbers.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree that you will not:

User Content and Ownership

You retain ownership of the recordings, location data, links, and other content you create using the App ("User Content"). You are solely responsible for your User Content and for ensuring you have any rights and consents necessary to create and share it. You grant us a limited license to host, store, process, and transmit your User Content solely to provide the Service to you - for example, to store your recordings, generate Live Witness links you request, and operate the App through the service providers described in our Privacy Policy. When you share a Live Witness link, you understand that anyone who has that link can view the associated session.

Important Safety Disclaimer

SafeHer is not an emergency service. The App does not contact the police, 911, or any emergency dispatcher, and it must not be relied upon as a substitute for one. In an emergency, call your local emergency number. We do not guarantee that any recording will start, complete, upload, be delivered, or be available, and the App may fail to function due to device, network, permission, power, or other conditions outside our control. You are responsible for the lawful use of the App, including obtaining any consent required by law to record audio or video in your jurisdiction. The App is provided as a supplemental tool only, and you use it at your own risk.

Disclaimers

Except as expressly stated in these Terms, the App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, secure, error-free, or that recordings, uploads, links, or notifications will be timely, complete, or delivered. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, RailSplit Games LLC and its officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of recordings, loss of evidence, personal injury, or harm, arising out of or relating to your use of or inability to use the App, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or twenty-five U.S. dollars ($25). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless RailSplit Games LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your use or misuse of the App, your violation of these Terms, or your violation of any law or the rights of any third party, including any recording made without legally required consent.

Termination

You may stop using the App at any time and may request deletion of your account by contacting us. We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms, if we are required to do so by law, or if we discontinue the App. Upon termination, your right to use the App ends. Sections of these Terms that by their nature should survive termination - including ownership, disclaimers, limitation of liability, and indemnification - will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the App will be resolved in the state or federal courts located in the State of California, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits any rights you have under the mandatory consumer-protection laws of your place of residence.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice within the App. Your continued use of the App after the updated Terms take effect means you accept the changes. If you do not agree to the updated Terms, you must stop using the App.
